Terms of Service

Welcome to Family Pocket. These Terms of Service ("Terms") govern your access to and use of the Family Pocket platform, including our website, mobile applications, and related services (collectively, the "Service"). By registering for or using the Service, you agree to be bound by these Terms.

1. Definitions

"Platform" refers to the Family Pocket software-as-a-service application, including all web dashboards, mobile apps, kiosk applications, and APIs.

"Institution" refers to any school, church, or organization that registers for the Platform.

"Administrator" refers to the individual who registers an Institution on the Platform and serves as the primary point of contact.

"Commitment Fee" refers to the refundable KES 5,000 payment required during Institution registration.

"Configuration Fee" refers to the fee charged for the initial setup, customization, and deployment of the Platform for an Institution.

2. Institution Registration

To register an Institution on the Platform, the Administrator must:

  • Provide accurate and complete information about the Institution and the Administrator.
  • Accept these Terms of Service.
  • Pay the Commitment Fee of KES 5,000 via M-Pesa.

Registration is only confirmed upon successful receipt of the Commitment Fee. Family Pocket reserves the right to reject any registration that contains false, misleading, or incomplete information.

3. Commitment Fee Policy

Important: Please read this section carefully.

The Commitment Fee of KES 5,000 is required to demonstrate genuine interest in using the Platform. This fee serves to ensure that only serious institutions proceed with the registration process.

Refund Policy: The Commitment Fee is refundable exclusively through deduction from the first payment made to Family Pocket after configuration. This includes, but is not limited to, the Configuration Fee or the first subscription payment.

For example, if the Configuration and Training Fee is KES 20,000, the Institution will only be required to pay KES 15,000, as the KES 5,000 Commitment Fee will be deducted from that amount.

The Commitment Fee is NOT refundable in cash, bank transfer, M-Pesa reversal, or any other method. It can ONLY be applied as a deduction from the first payment to Family Pocket.

If the Institution decides not to proceed after paying the Commitment Fee and before configuration begins, the fee remains as a credit on the Institution's account and can be applied if the Institution decides to register at a later date within 12 months. After 12 months, unclaimed credits are forfeited.

4. Configuration and Setup

Upon successful registration and payment of the Commitment Fee:

  • A support ticket will be opened automatically, and our technical team will contact the Administrator within 12 hours to begin the configuration planning process.
  • A technician may visit the Institution to gather additional information required for setup, including but not limited to: bus routes, student data, staff information, and operational preferences.
  • The Configuration Fee covers the cost of initial setup, data migration, training, and deployment. The exact fee will be communicated during the configuration planning phase and must be agreed upon before work begins.

5. Data Collection and Usage

During registration, we collect the following information:

  • Administrator's full name, email address, phone number, national ID, and role/position.
  • Institution name, type (school or church), physical location (GPS coordinates), and area name.

This data is used solely for the purposes of:

  • Processing your registration and verifying your identity.
  • Communicating with you about your registration status and configuration.
  • Setting up and maintaining your Institution's account on the Platform.
  • Internal record-keeping and billing.

6. Administrator Responsibilities

The Administrator agrees to:

  • Provide accurate, current, and complete information during registration.
  • Be authorized to act on behalf of the Institution.
  • Respond to communications from the Family Pocket team in a timely manner.
  • Ensure that the Institution complies with all applicable laws and regulations.
  • Not misuse the Platform or attempt to access systems or data beyond authorized scope.

7. Service Availability

Family Pocket strives to maintain high availability of the Platform. However, we do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen technical issues may temporarily affect service availability.

We will make reasonable efforts to notify Institutions of planned downtime in advance.

8. Subscription and Payments

After configuration, the Institution will be enrolled in a subscription plan. Details of available plans, pricing, and billing cycles will be provided during the configuration planning phase.

All payments are processed via M-Pesa or other approved payment methods. Failure to make timely payments may result in suspension or termination of access to the Platform.

9. Termination

Either party may terminate the agreement by providing 30 days written notice. Upon termination:

  • The Institution's access to the Platform will be revoked.
  • Family Pocket will retain Institution data for 90 days, after which it will be permanently deleted unless otherwise required by law.
  • No refund of subscription fees already paid will be issued for the remaining period.

10. Limitation of Liability

To the maximum extent permitted by law, Family Pocket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use the Platform.

Family Pocket's total liability for any claim arising from these Terms shall not exceed the total amount paid by the Institution to Family Pocket in the 12 months preceding the claim.

11. Modifications to Terms

Family Pocket reserves the right to modify these Terms at any time. Material changes will be communicated to registered Institutions via email at least 30 days before taking effect. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.
